What role do regulators play in implementing the Mental Capacity Act?
Representatives from three regulators of health and social care will appear before the House of Lords Committee charged with investigating the Mental Capacity Act 2005, on Tuesday 29 October
In the first session, at 10.40 am, the Committee will hear from David Behan, Chief Executive of the Care Quality Commission (CQC), and Andrea Sutcliffe, recently appointed Chief Inspector of Adult Social Care for CQC, about the recently announced plans to improve the way it inspects care services, following a number of high-profile failings in both hospitals and care homes.
The Committee will explore with the Care Quality Commission to what extent the wide-spread non-compliance with the Act is a result of wider failings in care standards; the role of regulation in achieving the culture change needed for the Act to be implemented more effectively; and whether there is any need for CQC to be granted further statutory powers.
They will be followed, at 11.40 am, by Paul Buckley, Director of Education and Standards at the General Medical Council and Marc Seale, Chief Executive and Registrar of the Health and Care Professions Council.
The Committee will ask the witnesses how the Act is incorporated into their inspection regimes; what they are doing to address particular challenges facing doctors in complying with the Act; and what role regulation can play in achieving culture change.
The evidence sessions will take place at 10.40 am on Tuesday 29 October in Committee Room 2 of the House of Lords.
