Lords to question EU Law Professor
As part of its ongoing inquiry into the UK's opt-in and International Agreements, the House of Lords EU Justice, Institutions and Consumer Protection Sub-Committee will question Marise Cremona, Professor of European Law at the European University Institute, on Wednesday 10 December.
Professor Cremona is an expert in European law and has a particular interest in the constitutional basis for EU external relations law and the external dimension of the area of freedom, security and justice, as well as the interaction between national, regional and international legal and policy regimes.
The Committee will question Professor Cremona on a number of issues including:
- her assessment of the legal reasoning in the Home Secretary and Secretary of State for Justice's letter, setting out a revised position on the Justice and Home Affairs opt-in;
- what she considers to be the impact of the Government's opt-in policy in relation to international agreements on legal certainty within the EU and also in the EU's relations with third countries;
- whether she thinks that the Commission has tried to circumvent the UK and Ireland's opt-in rights in any way; and
- considering the Law Societies of England and Wales and Scotland's opinion that the opt-in Protocol has reached a point where the European Court of Justice's case law will not be reversed by any further case law, what advice she would give to the Government on reconsidering its policy, given that this is the course of action she has recommended.
The evidence session will take place on Wednesday 10 December, at 4.05pm in Committee Room 1 of the House of Lords.
