Former Advocate General for Scotland to give evidence on role of Lord Chancellor and Law Officers

Tomorrow the House of Lords Constitution Committee will question Lord Keen of Elie, the former Advocate General for Scotland and former Lords Spokesperson for the Ministry of Justice and Home Office, for its inquiry into the role of the Lord Chancellor and the Law Officers.

The session will take place on Wednesday 27 April at 10.15 AM and can be followed on Parliament TV.

Topics that may arise include:

  • How the rule of law is protected within Government
  • Whether it is permissible for the Government to invite Parliament to legislate in breach of international law
  • How the duty to protect the rule of law should be applied in respect of international law
  • The role of the Law Officers and the value they provide over non-political legal advisers
  • The Law Officers’ accountability to Parliament
  • The appropriateness of the Attorney General as a member of the Government being involved in some decisions about whether to prosecute
  • Constitutional boundaries that constrain the Law Officers
