Consideration of Lords amendments

House of Commons voted 301 to 289 to disagree with Lords Amendment 62B to the Data Protection Bill, which relates to personal data for the purposes of journalism (Division 157). The Commons proposed new Amendments and the Bill now returns to the Lords for further consideration.

The Data Protection Bill 2017-19

Summary of the Bill

The European Union’s data protection framework is changing from May 2018:

• the General Data Protection Regulation (GDPR) will apply from 25 May 2018
• the Police and Criminal Justice Directive (the “Law Enforcement Directive” or LED) has to be transposed into law by 6 May 2018

The Bill has a number of purposes:

• it sets out how the UK would apply the derogations available under the GDPR
• it would bring the LED into UK law
• it would update the laws governing the processing of personal data by the intelligence services
• it aims to ensure that the UK would be able to freely exchange data with the European Union post-Brexit
• it would repeal the Data Protection Act 1998.

• Amendment 15, the House divided 310 - 282 against the Amendment (Division 154)
• Amendment 5, the House divided 310 - 282 against the Amendment (Division 155)
• New Clause 18, the House divided 304 - 295 against the New Clause (Division 152)

The Data Protection Bill Committee considered the Bill from 13 March to 22 March 2017. The Public Bill Committee then reported the Bill to the House with amendments.

Second Reading

The Second Reading debate took place on 5 March 2018. The Secretary of State for Digital, Culture, Media and Sport, Matt Hancock, opened the debate on behalf of the Government. Shadow Secretary of State for Digital, Culture, Media and Sport, Tom Watson, responded on behalf of the opposition.

The Bill passed Second Reading without a division.
