This week in the House of Commons MPs debated Brexit and the Mental Capacity and Financial Services Bills were scrutinised.

Brexit Next Steps Debate

On Thursday 14 February MPs debated the Prime Minister's latest motion on Exiting the European Union. Various MPs proposed amendments, but the motion ultimately failed to win a majority in the House of Commons.

Legislation

Mental Capacity (Amendment) Bill: Remaining Stages

The Bill amends the Mental Capacity Act 2005, which provides a statutory framework for people who lack capacity to make decisions for themselves. The Bill is based on the recommendations of the Law Commission report Mental Capacity and Deprivation of Liberty, which was published together with the Law Commission's draft Bill in March 2017.

The House of Commons voted 299 to 241 to approve the third reading of the Mental Capacity Bill. The Bill will now return to the House of Lords for further consideration.

Financial Services (Implementation of Legislation) Bill

This Bill would give the Government powers to implement and change 'in flight' files of EU financial services legislation in UK law.

These powers will last for two years after Brexit, in the event of a 'no-deal' scenario.

'In flight' refers to EU legislation that:

  • has been adopted by the EU but not yet enacted,
  • or is currently in negotiation and may be adopted in the two years following EU withdrawal

This Bill passed its second reading on Tuesday 12 February.
