In 2009 the Department for Culture, Media & Sport and the Gambling Commission conducted a joint review of remote gambling regulation. The review proposed that overseas gambling operators should be required to obtain a Gambling Commission licence in order to transact with, or advertise to, British-based consumers
A consultation period took place between March and June 2010. The consultation received 38 responses and proposed a more stream-lined white listing process for non-EEA jurisdictions. The draft Bill, published in December 2012, is intended to implement the proposals.
In its July 2012 report into the operation of the legislation relating to gambling, The Gambling Act 2005: A Bet Worth taking?, the CMS Committee came to a number of conclusions about the position of the remote gambling industry. In particular, it was concerned about the movement of the UK remote industry offshore from the point of view of both consumer protection and an equitable approach to taxation of all gambling operators, online and offline, UK-based and offshore.
In this first evidence session, the Committee will have the opportunity to question the Remote Gambling Association, CARE and the Sports Betting Group about licensing and consumer protection and concerns about the effectiveness and proportionality of the provisions in the draft Bill.
