Joint Committee on Prisoner Voting hears from former Lord Chancellor

The Parliamentary Joint Committee on the Draft Voting Eligibility (Prisoners) Bill will take evidence from Lord Mackay of Clashfern, former Lord Chancellor and Lord High Advocate. The Committee will also hear from prominent academics as they continue their pre-legislative scrutiny of the Draft Bill

The Committee will ask Lord Mackay whether, where rights are not explicitly referenced in the European Convention on Human Rights - as with the right to vote - they should still be seen as enforceable rights. They will also ask for his view on the possibility of a ‘democratic override’ where there is disagreement between national parliaments and the European Court of Human Rights, as well as on the legal and political consequences of non-compliance with the Court’s judgments.
