Pre-legislative scrutiny of the Government's draft legislation on energy

The Energy and Climate Change Committee is conducting pre-legislative scrutiny of the Government's policy paper: Draft legislation on energy, which was published by the Department of Energy and Climate Change on 21 January.

The Government states that the package of measures once enacted would:

  • enable Government to drive timely delivery of smart meters. Smart meters will help put households and businesses in control of their energy usage
  • provide the Gas and Electricity Markets Authority (the Authority) with powers that support the introduction of arrangements for next-day switching and ensuring that suppliers use consumers' actual half hourly electricity consumption data in settlement processes, boosting competition and assisting consumers
  • enable competitive tenders for some onshore electricity assets, fundamentally changing the way network investment is made while driving savings for consumers

Terms of reference

The Committee invites responses addressing some, or all, of the following questions in no more than 3,000 words:

  • Are the proposals in the draft legislation sufficient to achieve the Government's stated aim of increasing competition in the energy market and reducing energy costs for consumers?
  • Are the draft legislation's provisions necessary, workable, efficient and clear? If not, what changes need to be made?
  • Are there any relevant omissions from the draft legislation, particularly in relation to the measures on supply and switching and competitive tendering?

The Committee invites all interested parties to address these questions and any other aspect of the draft legislation in writing by Thursday 11 February 2016.
