Using Big Ben audio feed and recordings
Parliament has made the audio feed and sound recordings of Big Ben and other bells in the Elizabeth Tower, Palace of Westminster available for use, subject to Parliamentary copyright and this licence.
Licence
1. The material to which this licence applies (“the Material”) is the audio feed and/or sound recordings of Big Ben and other bells in the Elizabeth Tower, Palace of Westminster, made available by the Parliamentary Broadcasting Unit.
2. Parliamentary copyright (within the meaning of section 165 of the Copyright, Designs and Patents Act 1988) applies to the Material.
3. The Licensor grants you a worldwide, royalty-free, perpetual, non-exclusive licence to use the Material subject to the conditions below.
4. This licence does not affect your freedom under fair dealing or fair use or any other copyright or database right exceptions and limitations.
5. You are free, subject to the following conditions, to copy, publish, distribute and transmit the Material.
Conditions of Use
6. The Licensor may choose to make the live feed of the Material available to you only at specific times.
7. The Licensor does not, in granting this Licence, guarantee that the Material will be made available continuously or at any particular times, or that it will of be of a particular quality or that background noise (for example, a fire alarm) will not be audible.
8. The Licensor will therefore accept no liability to you or to any third party if (for whatever reason) the Material is not made available either continuously or at any specific time or if its quality is sub-optimal or if background noise is audible in the Material.
9. You must not use the Material for any of these purposes:
(a) ridicule or denigration;
(b) advertising, promotion, commercial sponsorship, or any other form of publicity for commercial purposes or financial gain.
10. You may not use the Material in any way that:
(a) suggests that the UK Parliament or the House of Commons or the House of Lords or any individual Member of either House endorses, promotes, supplies, or approves of you or your product; or
(b) suggests you have exclusive access to the material.
11. Unless you have the Licensor’s express consent in writing, you may not rent or sell the Material to third parties, charge third parties to view it, or use it for corporate, commercial, or professional purposes.
12. You may not do any of the following:
(a) edit, alter, add to, distort, or digitally manipulate the Material in any way, except to select and reproduce excerpts from it; or
(b) reproduce the sound out of context.
13. You may not use the Material (including on any website, social media or any other platform) in way that:
(a) promotes, encourages, or facilitates illegal activity;
(b) encourages hatred on grounds of age, disability, gender identity or reassignment, marriage or civil partnership, race, religion or belief, sex, or sexual orientation or promotes, encourages, or facilitates anti-social behaviour; or
(c) is intended primarily to advertise or promote commercial activity.
14. If you fail to comply with the conditions set out above, the rights granted to you under this licence, or any similar licence granted by the Licensor, will end automatically.
Variation or termination
15. The Licensor may change these terms or terminate this licence at any time. We will update the terms on www.parliament.uk when a change is made. It is your responsibility to check that you are complying with the updated terms.
Governing law and jurisdiction
16. This licence is governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the Courts of England and Wales.
Definitions
17. In this licence, the terms below have the following meanings:
‘Licensor’ means the Speaker of the House of Commons and the Clerk of the Parliaments representing the House of Commons and House of Lords respectively;
‘Material’ has meaning given in clause 1;
‘Use’ means doing any act which is restricted by copyright, whether in the original medium or in any other medium, and includes without limitation distributing, copying, adapting and modifying as may be technically necessary to use it in a different mode or format.
‘You’ means the natural or legal person, or body of persons corporate or incorporate, acquiring rights under this licence.
